Comment vendre un bout de son jardin et renoncer à une servitude

Mes voisins aimeraient acheter un bout de mon jardin et renoncer à leur droit de passage qui passe devant chez moi. Comment est-ce qu'il faut faire?

Lors du partage d'un bien familial, il se peut que des terres soient divisées entre plusieurs membres d'une même famille avec éventuellement la création de droits de passage. Plus tard, souvent après la vente d'une ou plusieurs parcelles de la propriété d'origine, les arrangements ne conviennent plus et il faudrait envisager des changements.

Dernièrement, nous avons eu le cas d'un bout de jardin qui appartient à M. A qui se trouve devant chez M. et Mme. X. M. et Mme. X ont deux accès, dont un qui passe devant chez M. A. Tout le monde est d'accord pour que M. et Mme. X achètent le bout de jardin et ils renonceront à leur servitude de passage devant chez M. A.

Établir les nouvelles limites

Tout d'abord, il faut regarder ensemble pour se faire une idée des nouvelles limites. Il est impératif de prendre en compte des questions pratiques. Par example, dans notre cas, il aurait été envisageable de tracer une ligne droite mais il s'avère que, en faisant ainsi, la fosse septique de M. A se trouverait sur le terrain de M. et Mme. X. Une telle situation est à éviter donc il faudrait envisager un contournement.

Voici le lien vers un site très utile à cet égard: geoportail.gouv.fr Avec ce site, vous pouvez regarder les parcelles cadastrales existantes, dessiner les nouvelles limites, mesurer les surfaces etc.

Le géomètre

Il est intéressant de poser quelques piquets et faire un croquis des nouvelles parcelles pour préparer le dossier mais l'intervention d'un géomètre est nécessaire pour que les nouvelles limites soient reconnues juridiquement. Le géomètre procède à la pose des bornes (bornage) et souvent il doit créer des nouvelles parcelles et mesurer les surfaces (arpentage). Clairement, ce travail engendre des frais. Le coût exact dépendra de ce qu'il faut faire exactement et le nombre de bornes à poser. Quand il est possible de tracer une ligne droite, il n'y aura besoin que de poser deux bornes (voire une s'il y a déjà eu un bornage). Il faudrait prévoir au minimum 1.000 euros et demander un devis. À vous de décider si les frais seront partagés ou à la charge d'une des parties. La loi prévoit le partage des frais dans le cas où on oblige son voisin à borner selon l'article 646 du Code Civil. Sinon, il s'agit d'un accord à l'amiable.

Le notaire

La signature d'un acte devant notaire est obligatoire pour transférer la propriété du jardin, comme pour toute transaction immobilière. Un accord signé par les voisins entre eux ne sera pas suffisant! Il en va de même pour enlever la servitude. Normalement, une servitude est créée par acte notarial et il faut également un acte authentique pour la modifier. Il ne faut pas négliger cette formalité. Si M. A ne fait pas les choses corréctement, il pourrait perdre une partie de son jardin et se retrouver avec M. et Mme. X, ou leurs acheteurs, qui repassent devant chez lui sans pouvoir les en empêcher...

Le prix

Naturellement, il faudrait convenir d'un prix pour le bout de jardin. Un notaire ou un évaluateur/expert immobilier pourra vous conseiller à ce sujet. Estimer un jardin dépend vraiment de la situation et surtout s'il existe un marché pour les jardins localement. Si le jardin est constructible, le prix au m2 pour les terrains à bâtir sera utile. Dans d'autres cas, dans certains villages il y a des jardins qui se vendent (par exemple, dans des villages où il y a peu de maisons avec jardin au centre). Pourtant, assez souvent il n'y a pas véritablement de marché pour les jardins. Le prix à l'hectare des terres agricoles, ramené au m2, serait probablement trop bas pour motiver M. A (sauf si c'est vraiment très important pour lui de supprimer le droit de passage...) donc le prix sera sûrement plutôt basé sur une valeur de convenance qu'une valeur vénale.
